- Then there should be publication of trademark in the Bulletin of Trademarks.
- The applications on protesting the registration of the right of ownership and from other market participants are accepted after the date of publication and within 30 days.
- Next, the examination proceedings is conducted, during which the uniqueness of the trademark and its compliance with the country's legislation shall be verified.
- After the positive results of verification, the certificate of registration is issued for 10 years.
Reasons for refusal of registering TM in Argentina
The Institute of Industrial Property may refuse to the applicant during the process of registration for the following reasons:
- Names, words and signs have high degree of similarity with already registered brands;
- Violation of legislation, ethical and moral aspects;
- Graphic images or words of the trademark mislead the consumer about quality, form and purpose of the proposed product or service;
- Words or images reserved by the state are used in whole or in part in the trademark;
- There is no originality;
- Personal data or name of natural person who has not consented to use his data are applied during the registration.
