Registration of trademark in Moldova
An application for registration of a trademark in Moldova should be filled in on the approved form and submitted in 2 copies by the applicant to the AGEPI. It should contain only one trademark. If the documents are not compiled in the state language, it is necessary to provide their translation within two months from the date of submission of the application.
The applicant has the right to submit the application by himself or through his representative on the basis of a power of attorney signed by him. Persons who do not reside in the territory of the Republic of Moldova submit applications only through the representative. As a rule, the power of attorney is issued for up to three years.
Documents for registering a brand name in Moldova
The application for registration of trademark should contain the following:
- Surname, name (designation), address, e-mail, telephone number of the applicant;
- Surname, name, address, e-mail, telephone number of the representative;
- Description and accurate image of the trademark;
- List of designations of goods and services for which registration of the trademark is necessary. They should be grouped according to the ICGS.
The application should be accompanied by graphic or photographic image of the trademark of 8X8 cm size. For three-dimensional trademark, the applicant shall provide flat (two-dimensional) graphic or photographic image.
The application shall be accompanied by:

The power of attorney signed by the applicant, if the application is submitted by the representative;

Priority document;

Receipt or other document concerning payment of the state fee in the manner prescribed by law;

The Charter confirming the use of collective trademark, if such is supposed to be registered.
The trademark is verified during the search among previously registered trademarks. After that, the analysis is carried out and the decision is made concerning the layout of trademark in Moldova, either it would be simple text, graphic or combined one.
The application is published in the special news-bulletin and its examination is conducted. At this stage, the objections of third parties are accepted. If such objections were not raised or were rejected, the trademark is considered as registered. After the official approval, the Certificate of registration of the trademark in the Republic of Moldova is issued. The trademark is valid for ten years, and it is subsequently permitted to be renewed for this period.
